UK homeowners with CCTV and smart doorbells risk £100,000 fines

Homeowners with smart doorbells or CCTV could be slapped with a whopping £100,000 fine, warns security guru Carlos Dhunay from Telcamm. As the summer season approaches, Carlos underscores the critical need for legal savvy and robust home security measures.

Carlos alerts that many homeowners are inadvertently flouting the law with their security devices. He cautions: "Many homeowners unknowingly break the law with their security cameras and smart doorbells."

He further explains the legal pitfalls, stating: "While having a security system is a great idea, if it records footage outside your property line, like a public sidewalk or your neighbour's garden, you could face hefty fines (up to £100,000) or even criminal charges for violating data protection laws."

Homeowners who fail to adhere to regulations risk facing the wrath of the Information Commissioner's Office (ICO).

The Data Protection Act (DPA) and the General Data Protection Regulation (GDPR) come into play when personal footage extends beyond the boundaries of one's abode, potentially capturing images of adjacent properties, communal spaces, or public thoroughfares. Non-compliance can attract serious penalties from the ICO or lawsuits from those impacted, reports the Mirror.

It's crucial for homeowners to take the necessary steps to ensure they're on the right side of the law when it comes to their home security systems.

Carlos remarked on the importance of clear signage for homeowners with surveillance systems, stating: "It's increasingly common for homeowners to install surveillance systems for safety benefits. However, it's essential to follow guidelines to avoid unlawfully filming individuals."

He warned against secret filming, advising: "Secretly filming, even on private property, is illegal. To avoid this, put up clear and visible signs at key entry points informing people that recording devices are in operation. This transparency deters crime and fulfils legal requirements."

He further emphasised the need for respecting privacy when installing CCTV or smart cameras: "For those considering CCTV or smart camera installations, it's vital to inform neighbours and ensure signs are prominently displayed to notify individuals of the recording."

Carlos added a reminder about neighbourly consideration: "Remember, security shouldn't come at the expense of your neighbours' privacy. Inform them and anyone potentially captured on camera, especially if the camera's view extends beyond your property. This proactive approach not only fosters community awareness but also helps in safeguarding privacy and avoiding misunderstandings or complaints."
