The Argentine wants to quit his post as head coach of Chile's national side.
He is on a shortlist of candidates to take over at Chelsea when interim boss Guus Hiddink leaves at the end of the season.
Chile's football association, the ANFP, announced on Tuesday that negotiations with Sampaoli over his release had broken down.
If no agreement can be reached then the ANFP will reportedly take their head coach to court.
The 55-year-old led Chile to Copa America success last season and is reportedly keen on heading to Europe.
Chelsea have him earmarked alongside Bayern Munich coach Pep Guardiola and Diego Simeone of Atletico Madrid.
Chelsea struggling to attract players amid 'relegation battle'
Guardiola has already confirmed he is leaving Bayern at the end of the season, with Manchester City and Manchester United both said to be keen on his appointment.
Simeone, meanwhile, could decide to quit Atletico after they were placed under a year-long transfer embargo by FIFA, which would greatly reduce his squad restructuring options in La Liga.
At 69, Hiddink is not expected to remain at Chelsea past the summer after taking over last month when Jose Mourinho was sacked.
