West Ham lost their appeal to get Andy Carroll's red card overturned [GETTY]
The Hammers threatened to take legal action after being left frustrated by the original decision taken by the FA's Regulatory Commission.
Carroll was shown a straight red in West Ham's 2-0 win over Swansea last weekend after appearing to strike Chico Flores when making an aerial challenge.
The three-match suspension starts as of immediate effect and so he will now miss fixtures against Aston Villa, Norwich and Southampton.
Carroll's ban will be a sore loss for West Ham, who are desperate to clamber out of the bottom three.
