That is the view of former Tottenham manager and BT Sport pundit Glenn Hoddle.
Hoddle says the tackle by Spurs right-back Serge Aurier on Toni Kroos was not worthy of a penalty.
Cristiano Ronaldo equalised from the spot-kick after an own-goal from Raphael Varane had given the visitors the lead.
“I don’t think it was a penalty personally,” Hoddle said.

“But what a wonderful little ball from (Luka) Modric, there’s not enough quick pressure on the ball.
“This is where the goal came from, the little inside ball there.
“I think he thinks Kroos is going to hit it but it stuck under his foot and it’s running away, the ball’s running away when he makes the tackle.”
Hoddle was working alongside former Manchester United and England centre-back Rio Ferdinand.

Ferdinand believes Tottenham star Aurier was “stupid” to go to ground in the box they way he did.
“But you know Glenn when you go to ground in the box like that, you’re giving the referee a decision to make,” he said.
“That’s the problem and that’s stupidity, if anything.”
Both sides had chances to win the game in the second half but goalkeepers Hugo Lloris and Keylor Navas were in fine form.
